CRIMINAL PROCEEDINGS AND THE USE OF AI

Challenges for Common Criminal Procedure Principles
and the Principles of the Rule of Law

Our research question

“Are current criminal procedure rules — particularly evidence law and procedural safeguards — sufficient to address the unique challenges posed by AI evidence?”

Our methodology

The project combines legal research with empirical insights, including echanges with legal practitioners, law enforcement, computer scientists, and policy makers.

  • Analyse and Compare
    • AI tools used across national criminal justice to generate, filter and analyse evidence
    • National rules on AI evidence admissibility
    • European and international policies regarding AI in criminal justice
  • Identify Challenges and Regulatory Gaps
The focus is on the potential risks AI evidence poses to fundamental rights, criminal procedure principles, and the rule of law.
  • Propose Policy Solutions at national and supranational levels
